Why you should have a valid driver’s license before you go to court in Maryland.
Firstly, it shows the judge that you are trying to do the right thing. When you arrive in a Maryland court, the first thing the prosecutor is going to do is ask your lawyer a question. “Is your client valid?” Getting a valid license shows the court that the reason your license was suspended in the first place has been resolved.
If you’re valid, you may get out of there quicker… and cheaper.
What if you can’t get a license?
If you are not valid by your court date, depending on your record, the prosecutor may ask you to plea. If you plea, you risk probation, fines and even jail time.
What if you have a good excuse for driving while suspended?
Maybe you have a good defense? Did you move and not get notice of the suspension? You’ll need some sort of documents proving your residence at the time the notice was mailed. And it doesn’t always work…
What if you don’t have a defense?
Getting the court to grant you a probation before judgement (PBJ) is essential. This will help you avoid points on your driving record. Without a PBJ, you will receive points on your record which will lead to yet another hold on your license. You will need a very large mop to clean this mess. This is an area where an experienced lawyer can really help.
Do you have any prior charges for driving suspended or driving without a license?
Are you a habitual offender? If it’s your first time, the judge is more likely to be lenient. But, once you start racking up 2 or more, the judge may try to get your attention. Rest assured, you won’t like the kind of attention the judge is going to give you.
Should you go to court without a lawyer?
