♦ Driving Under the Influence, or DUI
A DUI charge requires two parts. Either a breath test of .08 or more ( known as DUI Per Se) or a police officer believes that the amount of alcohol in your body has substantially impaired the driver’s coordination.
• 1st Offense DUI: 1 year and/or up to $1000.00 fine.
• 2nd Offense DUI: 2 years and/or up to $2000.00 fine.
• 3rd Offense or subsequent offenses: 3 years and/or up to $3000.00 fine.
Also, the MVA may add 12 points to your driving record and your driver’s license may be revoked.
♦ Driving While Impaired, or DWI
A DWI charge requires a breath test between .07 and .08 or a finding that alcohol has impaired the driver’s normal coordination to some extent.
• 1st Offense DWI: 60 days and/or up to a $500.00 fine.
• 2nd Offense DWI: 1 year and/or up to a $500.00 fine.
• 3rd or subsequent offense: 3 years and/or up to a $3000.00 fine.
Also, the MVA may add 8 points to the driver’s record and your license may be suspended.
